Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.83 of 2022, pending before the Court of learned J.M.F.C., Laxmipur, arising out of Bandhugaon P.S. Case No.25 of 2022, for alleged commission of offences under Section 376(2)(n)/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Koraput, by order dated 10.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the petitioner is in custody since March 2022.

Learned counsel for the State on instruction submits that charge-sheet has been filed on 27.04.2022.

Perused the 164 Cr.P.C. statement of the victim and the medical report.

Considering the same and taking into account the filing of charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.
Accordingly, the BLAPL stands disposed of.
