Mrs. Jena, learned counsel for the petitioner undertakes to remove the defects in course of the day including the payment of deficit authentication Court fee of Rs.3.30.

Heard learned counsel for the petitioner and learned Standing Counsel for the State.

Mrs. Jena, learned counsel for the petitioner submits that at the stage of recording statement under Section 313 Cr.P.C., the learned J.M.F.C., Balliguda issued the NBWA against the petitioner and in so far as the other accused persons are concerned, they have been acquitted of the charges in the meantime by a full-fledged trial. Considering the above submission, the Court is of the view that in the facts of the present case, the petitioner should be directed to surrender on a specific date and released on bail in order to ensure early disposal of the case.

Accordingly, it is ordered.

In the result, CRLMC stands allowed with a direction to the petitioner to surrender before the court of learned J.M.F.C., Balliguda in connection with G.R. Case No.376/2007(A) on or before 20th October, 2022 and in the event of his surrender, the court shall release him on bail with conditions as deemed just and proper in the facts and circumstances of the case. 6.
An urgent certified copy of this order be granted as per rules.
