This matter is taken up through hybrid mode.

This I.A has been filed by the Petitioner for modification of the order dated 12.10.2022.

Heard learned counsel for the Petitioner and the learned counsel for the State.

It is submitted by the learned counsel for the Petitioner that inadvertently it could not be brought to the notice of the Court that the Petitioner is involved Ainthapalli P.S. Case No.447 of 2018 for commission of the offence under Sections 294/ 323/ 337/ 341/ 427/ 506/34 IPC. It is further stated that non-mention of the criminal antecedent is not willful.

Taking note of the nature of accusation in Ainthapalli P.S. Case No.447 of 2018, this Court is persuaded to recall para-7 of the order dated 12.10.2022 passed in BLAPL No.9397 of 2022. Other terms of the order dated 12.10.2022 remain unaltered.

Learned Court in seisin over the matter is called upon to act on production of the order dated 12.10.2022 along with the order passed today.

I.A is accordingly disposed of.
