This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Mr. Mishra, learned Additional Government Advocate for the State submits that with the passage of time the writ petition has become infructuous. However it was pointed out that Prayer No.4 may still be surviving.

Since the Petitioner has retired from service after attaining the age of superannuation, the Prayer No.4 has become academic and such a question may be considered in some other matter involving a similar issue.

Keeping the question of law open, the present writ petition stands disposed of as infructuous.
