1. This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.302/34, I.P.C.
2. Heard Mr. G.C. Swain, learned counsel for the Petitioners as well as Mr. K. Das, learned A.S.C. for the State-Opposite Party.
3. It is submitted on behalf of the Petitioners that they are inside custody since 6.6.2019. It is further submitted that both the eyewitnesses, namely, Sujit Soreng and Sonu Naik have turned hostile during their examination in course of trial.
4. Upon hearing Mr. Das, learned Additional Standing Counsel for the State-Opposite Party and considering the statements of the witnesses including P.W. 3 & 4, it is directed to release the Petitioners on bail in connection with Sundargarh Sadar P.S. Case No. 94/2019 corresponding to S.T. Case No. 109/27 of 2019-21 on such terms and conditions to be fixed by the learned Additional Sessions Judge, Sundargarh as he deems just and
proper including the condition that the Petitioners shall attend the trial court on each date fixed.
5. The BLAPL is disposed of.
6. An urgent certified copy of this order be granted on proper application.
