This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.400 of 2020(A), pending in the Court of learned J.M.F.C., Patrapur arising out of Jarapada P.S. Case No.268 of 2020, for alleged commission of offences under Sections 376/294/323/506/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Berhampur by order dated 13.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.

Taking into account that the petitioner is in custody since 01.09.2022 and filing of final form since 12.01.2021, this Court

directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
