This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.269 of 2022, pending in the Court of learned S.D.J.M., Champua arising out of Jhumpura P.S. Case No.84 of 2022, for alleged commission of offences under Sections 376(2)(n)/506 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Champua by order dated 12.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that he is in custody since 14.08.2022 and as investigation has
progressed substantially; his further continuance in custody is unwarranted.

Perused the 164 Cr.P.C. statement of the victim. 7.
Considering the same and taking into account the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional police station once every week till the submission of final form.

Accordingly, the BLAPL stands disposed of.
