This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.1021 of 2022, pending before the learned S.D.J.M., Keonjhar, arising out of Keonjhar Town P.S. Case No.212 of 2022, for commission of offences under Section 379 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Keonjhar, by order dated 15.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that though the petitioner is not involved in the case at hand yet because of his criminal proclivity he has been arrayed as an accused and as such he has been remanded on 23.06.2022, hence the petitioner seeks release on bail.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that the petitioner has criminal antecedents of similar nature which also finds place in the order of rejection. 7.

Taking into account that the petitioner has been remanded in the case at hand, this Court directs the petitioner to be released on bail on terms to be fixed by the learned Court in seisin over the matter to ensure that the petitioner does not violate the terms of the order of bail.

Accordingly, the BLAPL stands disposed of.
