This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks for a direction to the learned Judge, Family Court, Khurda for early disposal of C.P. No. 29 of 2018.

Mr. Jena, learned counsel for the Petitioner submits that the Petitioner being the husband has filed C.P. No.29 of 2018 under Section 13 of the Hindu Marriage Act, 1955 for dissolution of marriage against the Opposite Party-Wife. The matter is otherwise ready and is being posted for hearing. Due to resurgence of COVID-19, the matter could not be heard. Since, at present, the Family Court, Khurda is functioning normally, a direction may be issued for early disposal of C.P. No.29 of 2018. It is further submitted that there is no legal impediment for early disposal of the same.

Taking into consideration the submission made by learned counsel for the Petitioner, this Court disposes of this writ

// 2 // petition with a direction that in the event the Petitioner files an application for early disposal of C.P. No.29 of 2018 stated to be pending before the learned Judge, Family Court, Khurda within a period of two weeks hence along with certified copy of this order, he shall do well to consider the same in accordance with law as expeditiously as possible preferably within a period of four weeks therefrom and proceed with the matter. Urgent certified copy of this order be granted on proper application.
