This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Learned counsel for the Petitioner submits that the Petitioner, who is a member of the Tax Bar Association, Cuttack, is apprehending arrest by police in connection with the present case, which is likely to be registered against him. However, learned counsel for the State, on instruction, submits that no such F.I.R. has been registered yet.

Accordingly, the ABLAPL is disposed of with liberty to the Petitioner to approach this court in the event of any such apprehension of arrest arises. Further, it is open for the Petitioner to follow the mandatory procedure under Section 41-A, Cr.P.C., as has been directed by Hon'ble the Supreme Court in the case of Arnesh Kumar vs. State of Bihar and another, (2014) 8 SCC 273, if the same ratio is applicable to the present case.
