Heard learned counsel for the petitioner and learned Order No.

counsel for the State.

Instant I.A. is filed by the petitioner for modification of the Court's order dated 10th October, 2022 passed in CRLMC No. 2741 of 2022 on the grounds stated therein.

Learned counsel for the petitioner submits that the Court's order dated 10th October, 2022 passed in CRLMC No. 2741 of 2022 could not be complied with as the petitioner was not aware of it and was out of the State and therefore, failed to surrender before the learned court below in time, hence, the extension is sought for.

Objection of Mr. Rout, learned AGA for the State is noted down.

Considering the submission of the learned counsel for the petitioner, the Court, though had directed the petitioner to surrender within a stipulated time as fixed and failed to do so, is inclined to extend the period for him to surrender in connection with G.R. Case No. 26 of 2017 (S.T. Case No. 4/18) arising out of Hinjilicut P.S. Case No. 38 of 2017 on or before 27th December, 2023 in compliance of the Court's order in CRLMC No. 2741 of 2022.

Rest part of the order remains unaltered.
