Heard Mr. K. Ray, learned counsel for the petitioner and Mr. M.K. Pati, learned Central Government Counsel. 2.

According to Mr.Ray, the Petitioner-Union is aggrieved by the non-reference of the industrial dispute raised by the Union vis-à-vis the removal of one Jugal Kumar Tete, Workman from his service though the Regional Labour Commissioner (Central)- cum-Conciliation Officer, Rourkela (opposite party No.2) has sent a failure report on 24.07.2019 under Annexure-3 to opposite party No.1. He submits that till date the opposite party No.1 has not taken any decision on such communication. 3.

During course of hearing, Mr. Ray submits that liberty may be granted to the Petitioner-Union to approach the opposite party No.1 afresh in the matter by filing a representation and the said opposite party be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court

// 2 // grants liberty to the Petitioner-Union to file a representation before the opposite party No.1 through registered post within a period of two weeks from today. In the event, such representation is filed along with a copy of this order, the opposite party No.1 is directed to take a decision on the same in accordance with law within a period of six weeks from the date of receipt of such representation and communicate the result of such exercise to the Petitioner-Union.

Accordingly, this writ petition is disposed of. 6.

Urgent certified copy of this order be granted on proper application.
