This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with P.R. No.72 of 2022-23, pending in the file of the learned J.M.F.C., Khallikote, arising out of 2(a) CC Case No.190 of 2022, for commission of offences under Section 52(a) of Odisha Excise Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Khallikote, by order dated 23.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the petitioner is in custody since 20.09.2022 and the nature of allegations and the punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking into account the criminal antecedent of the petitioner, it is directed that the petitioner shall appear before the Investigating Officer once every week till submission of final P.R. 7.

Accordingly, the BLAPL stands disposed of.
