This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.411 of 2022, pending in the Court of learned S.D.J.M., Nuapada, arising out of Nuapada P.S. Case No.134 of 2022, for commission of offences under Section 420/34 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge, Nuapada, by order dated 08.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the petitioner relying on final form dated 15.09.2022 which is on record submits that out of total amount of Rs.2,93,920/-(Rupees two lakh nine three nine hundred twenty), Rs.1,00,000/-(Rupees one lakh) recovered from the petitioner has already been deposited in the account of the

coordinator of the GPs and further sum of Rs.2,18,080/-(Rupees two lakh eighteen thousand eighty) has been deposited through online banking in the account of the NGO i.e. Sashakt Odisha. 7.

Considering the recovery as mentioned in the final form, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 8.

Accordingly, the BLAPL stands disposed of.
