This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Badagad P.S. Case No.356 of 2016, corresponding to C.T. Case No.28 of 2017, pending in the file of learned S.D.J.M., Bhubaneswar, for commission of alleged offences under Sections 420/406/467/468/471/294/506 and 34 of I.P.C.

Upon consideration of the submissions made by the respective parties as well as on perusal of the records and on consideration of the peculiar facts and circumstances of the case and in view of the fact that the Petitioner is languishing in jail custody since 16.08.2021, I am inclined to release the Petitioner on bail in the above case, subject to Petitioner furnishing a bail bond of Rs.30,000/- (Rupees Thirty thousand) with one local solvent surety for the like amount to the satisfaction of the learned court in seisin

// 2 // over the matter and subject to the condition that the Petitioner shall return a sum of Rs.2,25,000/- (Rupees Two lakhs twenty five thousand) to the Informant without prejudice to the rights and contentions of the Petitioner and further he shall not indulge in such type of offence while on bail and shall appear before the concerned Police Station once in a fortnight between 10 A.M. to 1 P.M. till completion of trial. The court in seisin over the matter is at liberty to impose any additional condition(s), if situation so warrants. 4.

The BLAPL is accordingly disposed of.
