Heard learned counsel for the Parties.

The Petitioners seek for a direction to the Commissioner, Cuttack Municipal Corporation for allotment of shop rooms in the newly constructed site keeping in view that the Applicants herein are all old shop owners and running shop is their only livelihood. 3.

This Court finds, in this regard, the Petitioners have made a representation at Annexure-3. In disposal of the Writ Petition, this Court permits the Petitioners, in the event they are still interested for allotment of shop rooms in the newly constructed shop room area, they may file appropriate applications before the Commissioner, Cuttack Municipal Corporation for its consideration. Let such applications be filed at least within two weeks, in which event, the Commissioner is directed to take decision on their applications

// 2 // within three weeks thereafter. If the Petitioners are running some sort of business and having their transaction on Footpath, for six weeks they may not be disturbed.
