Provided the pleading is complete and the Defendants file an undertaking that they will neither file any Miscellaneous Petition nor challenge any interlocutory order likely to be passed and not bring any miscellaneous application in the partition proceeding pending, on service of copy and filing of a copy of the order of this Court, the trial court shall do well in attempting to finalise the partition proceeding involved herein at least within a period of nine months from the date of communication of this order by the Petitioners. 2.

The CMP stands disposed of accordingly.
