This matter is taken up through hybrid arrangement (virtual/ physical) mode.

This is the second journey of the Petitioner in filing this application under Section-438 of the Cr.P.C. for his grant of bail in the event of his arrest in connection with Balasore Town P.S. Case No.180 of 2020 corresponding to C.T. Case No.589 of 2020 on the file of learned S.D.J.M., Balasore for alleged commission of offence under section-272/273/120-B of the IPC and section-52(a)/69 of the Odisha Excise Act for his release on bail in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the materials as placed; further keeping in view the earlier order dated 12.04.2022 passed by this Court in ABLAPL No.9453 of 2020, finding no changing circumstances; while being not inclined to reconsider the prayer for grant of anticipatory bail to the Petitioner, this application is disposed of with the observation that when the occasion would so arise before the learned Court in seisin of the case for consideration

// 2 // of the prayer for grant of regular bail to the Petitioner, the same would be made on its own merit; further taking into account all the subsequent event which taken place by then in their proper perspective and disposed of early in accordance with law. 5.

The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
