This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in Special G.R Case No.41 of 2022 pending in the file of learned Addl. District Judge-cumSpecial Court under POCSO Act, Balangir, arising out of Muribahal P.S Case No.78 of 2022, for offence under Section 363 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. District Judge-cum-Special Court under POCSO Act, Balangir by order dated 16.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Perused the statement of the victim recorded under Section 164 Cr.P.C.

Taking into account the tenor thereof an keeping in view that the final form has been filed on 2.8.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
