This matter is taken up through Hybrid mode.

This IA has been filed for recall of order dated 10th November, 2022, by which the IA for condonation of delay in filing the petition for restoration, i.e., CMAPL No.258 of 2021 [arises out of dismissal of the W.P.(C) No.23424 of 2016 for non-compliance of peremptory order].

As it appears, there is inordinate delay of 1082 days in filing the CMAPL. On perusal of the averments made in the CMAPL, it appears that the Petitioner had filed the CMAPL No.258 of 2021, which was dismissed on 10th November, 2022. The present IA is filed for recall of the said order. 4.
In view of the reasons stated in order dated 10th November, 2022, I am not inclined to recall the said order. Accordingly, the instant IA stands rejected.
