This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.233 of 2022, pending in the file of learned S.D.J.M., Parlakhemundi, arising out of Parlakhemundi P.S Case No.88 of 2022 for commission of alleged offences under Sections 294/435/379/506 & 34 of IPC read with Section 4 of Public (prevention of damage) Property Act and is in custody since 08.09.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Parlakhemundi, Gajapati by order dated 21.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.
It is submitted by the learned counsel for the petitioner that that co-accused have been released on bail by this Court by order
dated 27.07.2022 in BLAPL No.6385 of 2022. Hence he seeks release.

Taking into account the nature of the accusation and the punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Though the petitioner has criminal antecedents as stated by the learned counsel for the State, this Court directs the petitioner to appear before the local police station once every week till conclusion of trial and certification of such appearance shall be submitted before the learned Court in seisin over the matter. First date and time of such appearance be fixed by the learned Court in seisin.

It is needless to say, violation of any conditions shall entail cancellation of this order.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
