1. Enclosed with the rejoinder filed by the Petitioner is an order dated 23rd November 2021, passed by the National Green Tribunal (NGT) in OA Case No.101/2020/EZ, in which it has been noted, that the Government has no proposal to erect any high-rise buildings in the area in question since it is in the eco sensitive zone boundary of the Chandaka Wildlife Sanctuary in Odisha. The report of a Joint Committee submitted to the NGT stated that during field inspection, no construction of high rise building for other commercial activity was found. Interestingly, the order of the NGT also notes the pendency of the present writ petition.

2. In view of the above stand of the Government as reflected in the order of the NGT, Mr. Ragada, learned counsel for the Appellant seeks leave to withdraw the writ petition at this stage reserving the right of the Petitioner to seek appropriate remedies if the occasion so arises in future.

3. The writ petition is disposed of as withdrawn with liberty as prayed for.
