This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner files a memo indicating the pendency of the case before the District & Sessions Judge, Angul vide C.T. (Sessions) No.299 of 2022 which is taken on record.

The petitioner is an accused in connection with C.T. (Sessions) No.299 of 2022 pending on the file of learned District & Sessions Judge, Angul, arising out of Angul Sadar P.S. Case No.702 of 2022, for alleged commission of offences under Sections 341/294/323/436/506 of IPC and is in custody since 09.09.2022. 5.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Angul by order dated 23.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and the submissions of the learned counsel for the petitioner that no one is injured in the Act under Section 436 of IPC, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
