This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1202 of 2022 pending in the file of learned S.D.J.M., Angul, arising out of Purunakote P.S. Case No.100 of 2022, for alleged commission of offence under Sections 341/323/294/307/506 of IPC and is in custody since 13.09.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Angul by order dated 23.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner on instructions that the petitioner is in custody since 13.09.2022 and as charge sheet has already been filed on 09.11.2022, further continuance of the petitioner in custody is not warranted more so as the injured has been discharged and is leading a normal life.

It is also stated that the petitioner is a first offender. 7.
Taking into account the submissions made and period of custody and filing of charge sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

While releasing the petitioner on bail, learned Court is called upon to verify as to whether the injured is leading a normal life as stated and also verify assertion regarding the criminal antecedent of the petitioner. If it comes to the fore that the petitioner has any criminal antecedent of this order shall stand recalled.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
