This matter is taken up through hybrid arrangement Order No.

(virtual/physical) mode.

This the second journey of the Petitioner in filing this application under Section-438 of the Cr.P.C. who has been implicated in connection with Marine P.S. Case No.29 of 2020 corresponding to G.R. Case No.86 of 2020 on the file of learned Special Judge (POCSO), Berhampur for alleged commission of offence under section-363/376/(3)/376(2)(n)/109/506/34 of IPC read with section-6/17 of the POCSO Act for her reconsideration of grant of anticipatory bail in the event of her arrest in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the materials as placed as also the earlier order dated 17.11.2020 passed in ABLAPL No.13431 of 2020; while being not inclined

// 2 // reconsider the prayer for grant of anticipatory bail to the Petitioner, this Application stands disposed of with the observation that when the occasion would so arise before the learned Court in seisin of the case to consider the prayer for grant of regular bail to the Petitioner, the same shall be considered on its own merit; further taking into account all such developments which have taken place in the meantime in their proper perspective.

The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
