This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This Contempt Petition is filed alleging violation of the Court's order dated 29.06.2022 passed in W.P.(C) No.219 of 2021. 3.

It is submitted by learned counsel for the petitioner that the petitioner has submitted fresh representation on 26.10.2022 before the Principal Secretary to Government, Panchayati Raj and Drinking Water Department, Bhubaneswar pursuant to order passed by this Court. He further alleged that despite filing of the representation, the same has not been considered as of now.

Learned counsel for the State, on the other hand, submits that as per instruction received, no such representation has been filed by the petitioner before the Principal Secretary to Government, Panchayati Raj and Drinking Water Department, Bhubaneswar. On 26.10.2022 requesting the petitioner to file representation as has been

// 2 // directed by this Court. Further, a representation dated 07.07.2022 alleged to have been submitted by the petitioner is not supported the allegations as made in the present case.

In view of the facts and circumstances of the case, this Court disposes of the contempt petition with a direction to the petitioner to file a fresh representation along with copy of the order dated 29.06.2022 within a period of one week from today and a copy of this order. In the event the petitioner files fresh representation before the aforesaid authority within the time stipulated, the same shall be considered in accordance with law within a period of four weeks from the date of filing of such representation and shall take a decision in the light of the order dated 29.06.2022 passed in W.P.(C) No.219 of 2021. The decision so taken on the said representation shall be communicated to the petitioner within a period of a week thereafter. 5.

With the aforesaid observation/direction, the contempt petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
