This matter is taken up through hybrid mode.

Learned counsel for the petitioners undertakes to remove the defect within three days.

The Petitioners have filed this Writ Petition seeking direction to the opposite parties to take immediate step to treat the petitioners at par with the employees of aided educational institution in view of the principle decided in the case of Ritanjali Giri @ Paul v. State of Odisha (School & M.E. Deptt.) & others, 2016 (I) ILR-1162 and Prasanta Kumar Mohapatra & others (W.P.(C) No.23312 of 2020 disposed of on 28.09.2021) and to extend all benefits to them.

In course of hearing, learned counsel for the Petitioners states that highlighting the grievances, the Petitioners have made a representation to Opposite Party No.2 vide Annexure-5 and the same may be directed to be considered taking into consideration the principle decided in the case of Ritanjali Giri @ Paul and Prasanta Kumar Mohapatra, (supra) within a stipulated time, to which learned Counsel for the State has no objection.

As agreed to by learned Counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the Writ Petition directing Opposite Party No.2 to consider the
representation filed by the Petitioners vide Annexure-5, taking into consideration the principle decided in the case of Ritanjali Giri @ Paul and Prasanta Kumar Mohapatra, (supra), and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.

Issue urgent certified copy as per rules.
