1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. J.K. Mahapatra, learned counsel for the Petitioner.

3. Corrected copy of the cause title filed in Court be kept on record.

4. This transfer petition has been filed seeking transfer of RFA No. 82 of 2007 from the file of learned 3rd Additional District & Sessions Judge, Puri to the Court of learned District & Sessions Judge, Puri on the ground that the court of learned 3rd Additional District & Sessions Judge, Puri is not functioning.

5. A report has been submitted by the learned District Judge, Puri on 25.11.2022, wherein it has been indicated that neither of the Parties in RFA No. 82 of 2007 have moved to the learned District Judge for transfer of the matter on the ground indicated in the present transfer petition.

6. In view of the same, this Court while disposing the matter permits the Petitioner to move appropriate application before the learned District Judge, Puri for transfer of the matter by indicating the grounds.

7. It is observed that, if any such application is moved before the learned District Judge, Puri, he shall take necessary appropriate measure for transfer of the matter.

8. With the aforesaid observation the transfer petition is disposed of.
