This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offence punishable under Sections 420/468/471/506/34, I.P.C.

It is submitted by the Petitioners that initially the father of the present Petitioners, who is the owner of M/s. Basanti Automobiles, was arrayed as accused in this case, and at that time the present Petitioners were not party or partner to the said business. However, the father of the Petitioners, namely Dushasan Pradhan has passed away in the meantime. It is submitted further by the learned counsel for the Petitioners that the Petitioners have been summoned by the local police and are being harassed by the police frequently.

Considering such submission, nature of the allegation, gravity of the offence and the facts of the case, it is directed that, in the event of arrest, the Petitioners shall be released on bail by the Arresting Officer in connection with Soro P.S. Case No.242 of 2014 corresponding to C.T. Case No.512 of 2014 pending in the court of learned J.M.F.C., Soro, on such terms and conditions as the Arresting Officer may deem just and proper in the facts and circumstances of the case. However, this bail order is subject to the conditions that the Petitioners shall appear before the I.O. and shall cooperate with the investigation, as and when required by the I.O. 6.
The ABLAPL is disposed of accordingly.
