1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 21st August, 2021 in connection with Tangi P.S. Case No.172/2018 corresponding to G.R. Case No.1587/2018 pending in the court of learned J.M.F.C. (R), Cuttack for the alleged commission of the offence under Sections 498-A/302/304-B/34 of I.P.C.

4. The Petitioner is the brother-in-law of the deceased, who is said to have died due to burn injuries. It is alleged that the

// 2 // deceased was subjected to cruelty by her husband and in-laws including the Petitioner on several occasions prior to the occurrence. On the date of occurrence, the husband of the deceased severely assaulted her while her mother-in-law, the present Petitioner and one Babu Sahu poured kerosene on her and set her ablaze. The said Babu Sahu has been granted bail as per the order dated 16th November, 2021 passed by this Court in BLAPL No.8506/2021. It is further observed that trial has already commenced in which the informant and his mother have not supported the prosecution case.

5. Considering the above facts and taking into account the period of detention in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall personally appear before the court below on each date of posting of the case, failing which this order shall be treated as automatically cancelled and appropriate order be passed to take him to custody again.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
