Heard learned counsel for the Parties.

For the consistent view of this Court, nature of dispute involved herein cannot be adjudicated on entertainment of the Writ Petition involving examination of an order involving Section 15(b) of O.S.S. Act. This Court clearly observing in disposal of several Writ Petitions, if the parties so advised to bring civil dispute to settle the nature of dispute involved herein.

In the circumstance, this Court while declining to entertain the Writ Petition however observes, if the Petitioner herein so advised may bring appropriate civil proceeding involving the dispute involved herein for decision of the competent Court of law. It also observes in the event the civil dispute is brought, observation, if any, in Section 15(b) proceeding will have no room to play.

The Writ Petition thus stands disposed of.
