This matter is taken up through hybrid mode.

The Petitioner apprehending her arrest in Rourkela Plantsite P.S. Case No.261 of 2021 registered for alleged commission of offences punishable under Sections 363, 369, 370(3) read with Section 34 of the I.P.C., has filed this petition for her release on pre-arrest bail.

Heard the learned counsel for the Petitioner and the learned counsel for the State.

It appears that the Petitioner had come to this Court in ABLAPL No.9663 of 2021 which was disposed of on merit. Thereafter, she, being not satisfied with that order, has again approached this Court by filing this bail application for her release on pre-arrest bail on the ground that co-accused has already been released on bail.

Hence, I see no reason to allow the Petitioner to be released on pre-arrest bail by entertaining this subsequent petition under Section 438 of Cr.P.C. reviewing the earlier order.

Accordingly, the prayer for pre-arrest bail of the Petitioner stands rejected.

However, it is open to the Petitioner to surrender and move for bail before the Court in seisin over the matter and in that event, the Court in seisin over the matter shall do the needful in accordance with law.
