This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the parties.

This I.A. has been filed by the learned counsel for the Petitioner for modification of order dated 29.09.2022.

Learned counsel for the Petitioner submitted that the Petitioner is having one more criminal antecedent in addition to the present case. This case has been registered for commission of offences Sections 506, 351, 294, 34.

In such view of the matter, para-7 of the order dated 29.09.2022 is modified to the extent that in the event, more than one criminal antecedent as has been referred to hereinabove is there against the present Petitioner, then this order shall not be given effect to. 6.

In view of such modification, the time to surrender of the Petitioner before the Court below is extended to another four weeks from today subject to depositing cost of Rs.1,500/- (Rupees One Thousand Five Hundred) in the Utkal Gourav Madhusudan Library Fund, Orissa High Court Bar Association within fifteen days and furnishing money receipt thereof in proof of deposit.

It is made clear that, if the cost is not deposited within the stipulated time, time extended for the petitioner to surrender shall stand revoked automatically.

The I.A. is disposed of accordingly.

Urgent certified copy of this order be granted on proper application.
