This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.12 of 2022 pending on the file of learned P.O., Special Court under POCSO Act, Mayurbhanj, arising out of Baisinga P.S. Case No.352 of 2021, for alleged commission of offences under Sections 363/366/498-A/304-B/305/34 of IPC and Section 4 of the D.P. Act, Section 6 of POCSO Act and Section 9 of P.C.M. Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned P.O., Special Court under POCSO Act, Mayurbhanj by order dated 13.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner prays for withdrawal of the bail application.

Prayer is allowed. Learned counsel for the petitioner is permitted to withdraw the bail application.

Taking into account the petitioner is in custody since 02.12.2021 and since other co-accused have been released on bail, the learned Court in seisin over the matter is requested to conclude the trial within a period of three months from the date of receipt/production of certified copy of this order. 8.

It shall be open to the petitioner to renew his prayer in the event trial is not concluded within the time stipulated. Registry is requested to communicate the order.

Accordingly, the BLAPL stands disposed of.
