This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with 1 CC Case No.85 of 2021, pending in the Court of learned S.D.J.M., Rayagada, for commission of offences under Section 138 of the Negotiable Instrument Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Rayagada, by order dated 23.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and the punishment prescribed and the case arising out of complaint petition under Section 138 of the Negotiable Instrument Act, this Court directs the petitioner to be released on bail. Learned Court in
seisin over the matter shall fix the terms so as to ensure the presence of the petitioner on each date of trial. 6.
Accordingly, the BLAPL stands disposed of.
