Heard learned counsel for the petitioner and learned Standing Counsel for the State.

It is submitted that the petitioner's attendance was allowed to be dispensed with by the court below and in that connection, the learned J.M.F.C, Jaleswar passed an order dated 6th October, 2010 in terms of Section 205 Cr.P.C. However, subsequently, since he defaulted in appearance and as no step was taken by the engaged counsel, NBWA against the petitioner was issued by the impugned order dated 23rd August, 2018 under Anenxure-3. 3.
Considering the above facts and submission of Mr. Mishra, learned counsel for the petitioner and though the impugned order does not suffer from any infirmity, the CRLMC is disposed of with a direction to the petitioner to surrender before learned J.M.F.C., Jaleswar on or before 21st October, 2022 in connection with 1CC
Case No.226 of 2009 and in the event of his surrender, the court shall release him on bail with subject to conditions. 4.
An urgent certified copy of this order be granted as per rules.
