Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 374 of 2020 arising out of Dabugaon P.S. Case No. 130 of 2020 on the file of learned Additional District & Sessions Judge, Umerkote, registered for the alleged commission of offence under Section 302 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional District & Sessions Judge, Umerkote, by order dated 3.11.2020, the present BLAPL has been filed.

Perused the statement of the daughter of the deceased Sanji Gouda, medical evidence and the postmortem examination report.

Taking into account that the petitioner is in custody since 4.07.2020 and the trial has not commenced, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
