This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

This interlocutory application has been filed by the Petitioner for modification of the order dated 30.09.2022 passed by this Court in the aforesaid bail application.

Learned counsel for the Petitioner submitted that while permitting the Petitioner to go on bail vide order dated 30.09.2022, this Court had directed for verification of criminal antecedent of the Petitioner. At the time of surrender, the Petitioner came to learn that he has two criminal antecedents. Therefore, the order needs to be modified.

Considering such submission, the order dated 30.09.2022 is modified to the extent that in the event the Petitioner is having more

than two criminal antecedents of similar nature, then the order dated 30.09.2022 shall not be given effect to. However, release of the Petitioner shall also be subject to the Petitioner furnishing a cash security of Rs.5,000/- (Rupees five thousand) before the Court in seisin over the matter.

In view of such modification, the time to surrender of the Petitioner before the court below is extended to another four weeks from today subject to deposit of a sum of Rs.1,000/- (Rupees one thousand) in the Advocates' Welfare Fund of the Orissa High Court Bar Association within fifteen days hence and furnishing money receipt thereof as proof of deposit.

It is made clear that, if the cost is not deposited within the stipulated time, time extended for the Petitioner to surrender shall stand revoked automatically.

The I.A. is disposed of.

Urgent certified copy of this order be granted on proper application.
