Heard learned counsel for the Petitioner as well as the learned counsel appearing for the State.

No instruction has been furnished by the State-Opposite Parties. Mr.A.K.Chhatoi, learned counsel for the Petitioner submitted that the case of the Petitioner is squarely covered by the order dated 09.09.2016 passed in O.A.No.640 of 2013 and batch of cases, which has been annexed as Annexure-4 to the writ petition. He drew my attention to Annexure-3 dated 20.09.2011 of the Collectorate, Koraput which shows that the present Petitioner along with Ramani Ranjan Mohapatra and others has been regularised with effect from 01.01.2011 which was challenged in Annexure-4 wherein the Tribunal quashed Annexure-3 and has passed order that the Office

// 2 // Order dated 20.09.2011 issued by the Collector, Koraput, so far as it relates to the Petitioner is quashed. The Opposite Parties are directed to regularize the services of the Petitioner with effect from the dates they competed six years of continuous service as per Resolution dated 10.01.2008 issued by the Government of Odisha in Department of S & ME with all service and financial benefits, within a period of three months from the date of receipt of a copy of this order. 4.

Learned counsel for the Petitioner has brought to the notice of this Court to the said order vide Annexure-5 series dated 30.12.2017 by the Collector, Koraput. Hence the present Petitioner is also entitled to same benefit as Ramani Ranjan Mohapatra and others whose cases have been disposed of vide Annexure-4. 5.

Hence the writ application is allowed. In view of the above analysis the office order dated 20.09.2011 issued by the Collector, Koraput, so far as it relates to the Petitioner is quashed. The Opposite Parties authorities are directed to regularise the service of the Petitioner with effect from the date he completed six years of continuous service as per Resolution dated 10.11.2008 issued by the Government of Odisha in School & Mass Education Department with all service and financial benefits, within a period of three months from the date of production of certified copy of this order. 6.
