1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. B.S. Mishra, learned counsel for the Petitioner and Mr. J. Sahoo, learned counsel appearing for the Opp. Party.
3. The transfer petition has been filed seeking transfer of C.P. No. 165 of 2022 pending in the Court of the learned Judge, Family Court, Khurda to the Court of learned Judge, Family Court, Puri.
4. It is contended that the proceeding initiated by the Petitioner in C.P. No. 256 of 2022 as well as CRP No. 70 of 2022 are pending before the learned Judge, Family Court, Puri. Accordingly, it is contended that the proceeding filed by the husband in C.P. No. 165 of 2022 under Sec. 9 of the Hindu Marriage Act before the learned Judge, Family Court, Khurda be transferred to the Court of learned Judge, Family Court, Puri.
5. Considering the grounds taken in the transfer petition and the submissions made by learned counsel appearing for the Parties as well as the decisions governing the field, this Court is inclined to
// 2 // allow the prayer as made in the transfer petition. Accordingly, this Court directs the learned Judge, Family Court, Khurda to transfer C.P. No. 165 of 2022 to the Court of learned Judge, Family Court, Puri forthwith on receipt of this order.
