This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.476 of 2022, pending in the file of learned S.D.J.M. Nuapada, arising out of Jonk P.S. Case No.183 of 2022, offence under Sections 457/380/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned ADJ, Nuapada by order dated 12.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that he is in custody since 11.08.2022 and as charge sheet has been filed on 31.08.2022, further continuance of the petitioner in custody is not warranted.

Learned counsel for the State opposes the prayer for bail inter alia on the ground of criminal proclivity of the petitioner as borne out from the order of rejection.

Considering the filing of the charge sheet and the nature of allegations in the case at hand and release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in the seisin over the matter. 8.

To allay the legitimate apprehension of the learned counsel for the State, it is directed that petitioner shall appear twice every week before the jurisdictional police station till the conclusion of trial. First date and time of such appearance to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
