Heard Mr. D.K.Patra, learned counsel for the Petitioner and Mr. A.P.Das, learned Addl. Standing counsel for the StateOpposite Parties. 3.
The present Writ Petition has been filed challenging the order dated 13.04.2018 passed by the Government-Opposite Party No.1 under Annexure-2-Series.

Mr. Das, learned Addl. Standing Counsel for the StateOpposite Parties that the impugned order dated 13.04.2018 has been passed against the order of conviction and sentence passed against the Petitioner by the learned Special Judge, (Vigilance), Berhampur in Berhampur Vigilance P.S. Case No.52 dated 24.12.2009.

It is further submitted that against the said order of conviction and sentence passed on 07.03.2017, the Petitioner has already approached this Court in Criminal Appeal No.165 of 2017 and this Court while admitting the matter has not passed any interim order staying operation of the order of conviction and sentence.

In that view of the matter, this Court finds no illegality or irregularity in the office order dated 13.04.2018 and accordingly while not inclined to entertain the Writ Petition. It is observed that such order shall be subject to final outcome of Criminal Appeal No.165 of 2017.
