This matter is taken up through hybrid mode.

The petitioner has filed this writ petition seeking direction to the opposite parties to pay the salary and other service benefits due to him for the period from 06.04.2021 to till rejoining in new assignment i.e. 21.08.2003 by treating the said period as duty period in view of the order under Annexures-5 and 6 within a stipulated time. 3.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party no.1 vide Annexure-9 and the same may be directed to be disposed of within a stipulated time taking into consideration the order dated 01.11.2022 passed by this Court in W.P.(C) No. 10199 of 2022 (Tapan Kumar Barik v. State of Odisha and Ors.), to which learned State Counsel has raised no objection.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing the opposite party no.1 to consider the representation filed by the petitioner vide Annexure-9, taking into consideration the order dated 01.11.2022 passed by this Court in W.P.(C) No. 10199 of 2022 (Tapan Kumar Barik v. State of Odisha and Ors.), and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order. Issue urgent certified copy as per rules.
