Heard learned counsel for the Parties.

Case of the Petitioner involved appears to be based on expiry of passport of the Petitioner stood automatically cancelled on 2.2.2021, applied for renewal of passport, vide Annexure-2 also making necessary payment, vide Annexure-3. Entering into enquiry, the Regional Passport Office issued a letter to the Petitioner on 2nd June, 2022 asking for certain clarification. It appears, pursuant to the communication under Annexure-4, the Petitioner already submitted his response on 30.8.2022 and claimed to have met the clarifications sought for. For the submission of the learned counsel for the Petitioner, there is no final outcome, as there is no further communication to the Petitioner in this regard.

Mr.Parhi, learned DSGI along with Mr.Padhi, learned C.G.C. appearing for the Passport Authority claimed dismissal of the Writ Petition on the premises of premature of the Writ Petition. 4.

This Court finds, for no decision by the Passport Authority, the Writ Petition becomes premature. In the above circumstance, this Court in disposal of the Writ Petition directs the Regional Passport Authority to conclude the proceeding initiated, vide Annexure-4 undertaking the exercise of consideration on the response of the Petitioner, vide Annexure-5 and if necessary involving the Petitioner for personal hearing for further satisfaction, if any, while taking decision at least within a period of one month from the date of communication of this order. The Regional Passport Authority shall also keep in view the direction of this Court dated 23.3.2022 in W.P.(C) No.4834/2022 in the decision making process. (Biswanath Rath) Judge M.K.Rout
