The petitioner has filed this writ petition seeking direction to the opposite parties to absorb/regularize his service keeping in view the law decided in the case of Secretary State of Karnataka v. Umadevi (3), 2006(4) SCC 1, State of Karnataka and others v. M.L.Keshari and others, 2010(II) OLR (SC) 982.

Mr. S. Rath, learned Additional Standing Counsel contended that the opposite party no.3 has filed the counter affidavit, wherein at paragraph 6.6 it has been stated as follows:- "That in reply to the averments made in para-6.6, it is submitted that the name of the NMRs/DLRs working under the administrative control of this office wherein the name of the applicant exists have been forwarded to the Respondent No.2 vide letter No. 2033 dt.05.06.2018 & Letter No.2060 dt. 28.06.2018 of the Regional Transport Officer, Bargarh for consideration of conferring "Temporary status" as per letter No.6632 dt. 23.05.2018 of the Under Secretary, STA, Odisha, Cuttack (Annexure-G.H & I)."

In view of the above, this writ petition stands disposed of directing opposite party no.2 to take a decision on the recommendation made as indicated above and pass a reasoned order taking into consideration the ratio decided in the case of Umadevi & M.L.Keshari (supra) within a period of three months from the date of communication of this order. 6.

Issue urgent certified copy as per rules.
