This matter is taken up through Hybrid Mode.

Order No 2.

Heard Mr. S.C. Bairiganjan, learned counsel for the petitioner.

The petitioner is aggrieved by the office order dated 30.12.2017 passed by Opp. Party No.2 under Anneuxre-9. 4.

This Court after going through the materials available on record finds that such an order has been passed in view of the conviction and sentence passed against the petitioner in Cuttack Vigilance P.S. Case No.33 of 2010 by the learned Special Judge, Vigilance, Cuttack and the petitioner challenging the same has approached this court in Crl. Appeal No.632 of 2014 and this Court while admitting the matter, has not stayed the order of conviction and sentence.

In view of such position, this Court finds no illegality and irregularity in the order dated 30.12.2017 passed under Anneuxfe-9 and accordingly, this Court is not inclined to entertain this Writ Petition and dismissed the same.

However, it is observed that the said order of dismissal shall be subject to the final outcome of the Crl. Appeal No.632 of 2014.
