This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This Interlocutory Application has been filed seeking modification of order dated 20.10.2022.

Learned counsel for the Petitioner submitted that by order dated 20.10.2022 the Petitioner was allowed to surrender and go on bail subject to verification of criminal antecedents. He further contended that on verification of criminal antecedent, it is found that the Petitioner is having more then two criminal antecedents involving the offence under section 506 of the Indian Penal Code. 4.

In such view of the matter the order dated 20.10.2022 is modified to the extent that in the event the Petitioner is having more than two criminal antecedents then this order shall not be given

Further, an additional condition is imposed to the effect that the Petitioner shall furnish a cash security of Rs.3,000/- (Rupees Three thousand) before the Court in seisin over the matter which shall be kept in interest bearing fixed deposit account in the name of the court in any nationalized bank and renew from time to time till disposal of the case. The said deposit shall be subject to the outcome of the trial. The release of the Petitioner shall also be subject to the condition that shall appear before the concerned Police Station once in a month preferably on Sunday between 10 AM. till 1 PM. for a period of three months.

Four weeks' further time from today is granted to the Petitioner to surrender as per order dated 20.10.2022, but subject to depositing cost of Rs.1000/- (Rupees One thousand) by the Petitioner in the Advocates' Welfare Fund of the Orissa High Court Bar Association within 15 days from today and furnishing money receipt thereof in proof of the said deposit.

It is made clear that, if cost is not paid within the aforesaid stipulated time, then the extension period to surrender shall stand automatically revoked.

The I.A. is accordingly disposed of.
