This CMP has been filed for a direction to the learned 2nd Additional Senior Civil Judge, Berhampur to dispose of the petition dated 11th February, 2022 filed under Order 1 Rule 10 C.P.C. in C.S. No. 31 of 2016 at an early date. 3.

Although it is submitted by learned counsel for the Petitioner that the petition under Order 1 Rule 10 C.P.C. in C.S. No. 31 of 2016 is still pending for consideration, but there is no material on record to appreciate such submission. 4.

This CMP is, therefore, disposed of with an observation that if the petition under Order 1 Rule 10 C.P.C. filed in C.S. No.31 of 2016 is still pending, the Petitioners are at liberty to move learned 2nd Additional Senior Civil Judge, Berhampur for early disposal of the same.
