1. The petitioner, a defaulting borrower with an outstanding liability of around Rs.24,10,000/-, as on today, is before the Court seeking protection from the sale of his sole residential house, offered as collateral security, being put to auction sale on 30th September,2022.

2. By earlier order dated 29.09.2022 as an interim measure, it was directed subject to deposit a sum of Rs.12,10,000/- by tomorrow i.e. 30th September,2022, the successful bid, if any, shall not be confirmed without the leave of the Court.

3. It is submitted by the learned counsel for the Bank that pursuant to the order passed by this Court, no deposit has been made by the petitioner. On the last occasion when the matter was taken up on 04.11.2022 none had appeared for the petitioner and to grant

// 2 // another opportunity, the matter was adjourned to 22.11.2022.

In view of the non-compliance of the condition of the interim order dated 29.09.2022 and lack of prosecution by the petitioner, the writ petition is dismissed.
