On receipt of notice the Opposite Party No.3 has already entered its appearance and filed a counter affidavit. In paragraph No.8 of the counter affidavit the Opposite Party No.3 has averred as follows:
"8. That, as regards the averments made in para 11 and 12 of the writ petition it is submitted that now the new site for their temporary rehabilitation has been development and plots have been allotted but the vendors are not occupying the allotted plots."

On perusal of the above this Court finds, there is substantial development on the aspect of temporary rehabilitation of the oustees inasmuch as the vendors. In such view of the matter, this Court
// 2 // disposes of this writ petition with a direction to the Executive Officer, Konark NAC-Opposite Party No.3 to finalize the issue of rehabilitation of temporary vendors.

The entire exercise shall be completed within a period of one month from the date of communication of an authenticated copy of this order alongwith a copy of the writ petition by the Petitioner. (Biswanath Rath) Judge Ayaskanta Jena
